Intellectual Property & Copyright Policy
Shri Balaji Overseas Trading Company ("Pala-G India", "we") respects intellectual property rights and expects our users, customers, and B2B partners to do the same. This policy explains what we own, how you may use our content, and how to submit or respond to an infringement complaint.
1. Our intellectual property
All content on palagindia.com — including but not limited to the Pala-G logo, brand name, product names, packaging artwork, photography, videos, recipe content, flavour names, written editorial, nutritional graphics, source code, typography choices, layout, and the underlying selection and arrangement of content — is owned by Shri Balaji Overseas Trading Company or its licensors and is protected under:
- Copyright Act, 1957 (as amended) — India
- Trade Marks Act, 1999 — India
- Berne Convention for the Protection of Literary and Artistic Works
- WIPO Copyright Treaty
- U.S. Digital Millennium Copyright Act (DMCA) — for takedown requests involving US persons
"Pala-G" is a trademark of Shri Balaji Overseas Trading Company, registered in Class 29 at the Trade Marks Registry of India. Unauthorised use of a confusingly similar mark is an offence under Section 29 of the Trade Marks Act 1999.
2. Limited licence to you
We grant you a limited, revocable, non-exclusive, non-transferable licence to view and share content on palagindia.com for personal, non-commercial use and legitimate business enquiry (for example, forwarding a product link to a colleague in a procurement email). You may NOT:
- Download, copy, or redistribute our product photography for any commercial purpose (including reseller listings, marketplace storefronts, or competing product pages) without written consent.
- Scrape, data-mine, or bulk-extract our catalogue, pricing, descriptions, or customer reviews using automated tools.
- Use our trademarks, logo, or product names to imply endorsement, partnership, or affiliation where none exists.
- Reverse engineer, decompile, or create derivative works from the Website code.
- Remove or obscure the "For illustration only" watermark or any copyright notice on our images.
Academic citation and editorial reference in good-faith journalism is permitted under fair-dealing provisions of the Copyright Act 1957 Section 52, provided attribution is given.
3. Photograph and image usage
All product photography, lifestyle imagery, and gift hamper photographs on palagindia.com are either (a) owned by Shri Balaji Overseas Trading Company or (b) licensed from third-party photographers under contracts that restrict downstream use. Using our images on another e-commerce listing, marketplace, social media ad, or printed catalogue without written licence is a copyright infringement and will be prosecuted.
If you are a customer sharing a photo of our product on your own social media for personal enjoyment, that is welcome and encouraged — please tag @palagindia. If you are a business, distributor, or content creator and need licensed images for commercial use, email Ourpalag@gmail.com with the subject line "Image licence request".
4. User-submitted content (reviews, photos, suggestions)
When you submit a product review, flavour suggestion, testimonial, photo, or comment to palagindia.com, you grant Shri Balaji Overseas Trading Company a worldwide, royalty-free, perpetual, sub-licensable, non-exclusive licence to use, reproduce, adapt, publish, translate, and distribute that content in any media for product, marketing, and editorial purposes. You represent that (a) the content is your original work or you have the rights to it, (b) it does not infringe any third-party right, and (c) it is truthful.
We may moderate, edit for length, or refuse content that is unlawful, defamatory, obscene, off-topic, or infringes another person's rights. We do not pay for reviews and do not remove negative reviews unless they violate this clause.
5. Notice of copyright infringement (Indian / international)
If you believe content on palagindia.com infringes your copyright or trademark, please send a written notice to our designated Grievance Officer (see below) containing:
- Your full name, postal address, telephone, and email.
- Identification of the copyrighted work or trademark you claim is infringed, with registration details where available.
- The exact URL(s) on palagindia.com where the allegedly infringing content appears.
- A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the rights holder.
- Your physical or electronic signature.

6. Counter-notice
If your content has been removed and you believe the removal was in error, you may submit a counter-notice containing the items above, plus a statement under penalty of perjury that you consent to the jurisdiction of the courts at New Delhi, India. We will evaluate the counter-notice and, absent independent legal action by the claimant, may restore the content.
7. Repeat infringers
We terminate access and commercial relationships with repeat infringers as required by law. A "repeat infringer" is any person or entity that has been the subject of two or more substantiated takedown notices.
